This website is operated by Rica& Underwear (also referred to as “Rica&”, “Ricaandunderwear”, “we”, “us” or “our”). Throughout the site, the terms “we”, “us” and “our” refer to Rica& Underwear. By accessing or using this website and/or purchasing products from us you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the site or our services.

Any new features, tools, or changes to the store will be subject to these Terms. We may update these Terms from time to time by posting the revised Terms on this page; your continued use of the site after changes are posted constitutes acceptance of those changes.

Our store is hosted on Shopify Inc., which provides the online e-commerce platform that allows us to sell our products and services.

1. ONLINE STORE TERMS

By placing an order or using the Service you represent that you are at least the age of majority in your jurisdiction or have obtained parental or guardian consent to use the Service. You agree not to use our products or site for any unlawful or unauthorized purpose and not to violate any applicable laws. You must not transmit viruses, malware, or any code of a destructive nature. Breach of these Terms may result in termination of your access and/or orders.

2. ACCURACY, COMPLETENESS & TIMELINESS OF INFORMATION

We attempt to be accurate in product descriptions, pricing, and availability; however, errors may occur. We are not responsible if information on the site is inaccurate, incomplete, or outdated. All content is provided for general information only and should not be the sole basis for decisions. We may modify or remove content at any time without obligation to update.

3. ORDERS, PRICING & PAYMENT

Prices and available promotions are subject to change without prior notice.
We accept payment methods shown at checkout. By submitting payment information you represent and warrant that you are authorized to use the chosen payment method.
All payments are processed securely by our payment processors; we do not store full payment card details.
You are responsible for any applicable taxes, duties, or customs fees associated with your order.

We reserve the right to refuse, limit, or cancel orders at our discretion (including but not limited to orders that appear to be placed by resellers, for fraud prevention, or where errors exist). If we cancel your order after charging you, we will refund the amount charged.

4. SHIPPING, RETURNS & REFUNDS

Shipping options, costs and estimated delivery times are displayed at checkout. Shipping times are estimates and may vary.

If you receive a damaged or incorrect item, contact us at hola@ricaandunderwear.com within 30 days of delivery and include order number and photos.

5. PRODUCT AVAILABILITY & DESCRIPTIONS

Certain items may be available only in limited quantities. We do our best to display product colors and images accurately, but actual color may vary between monitors and devices. All product descriptions, images and pricing are subject to change without notice.

6. ACCOUNT INFORMATION & USER RESPONSIBILITIES

If you create an account, you must provide accurate, current and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use or security breach.

By submitting comments, reviews, images, ideas or other content (“User Content”), you grant Rica& a worldwide, perpetual, royalty-free, transferable, sub-licensable right to use, reproduce, modify, publish, translate, distribute and display such content in any media. You represent and warrant that you own or have the necessary rights to submit the User Content and that your submissions do not violate any law or third-party rights. We may moderate, refuse or remove User Content at our discretion.

8. THIRD-PARTY SITES, PRODUCTS & TOOLS

This site may contain links to third-party websites or services that are not owned or controlled by us. We are not responsible for the content, privacy practices, or policies of third parties. Use of any third-party tools, sites or services is at your own risk and subject to the third-party’s terms.

IN NO EVENT WILL RICA& UNDERWEAR (OR ITS AFFILIATES, DIRECTORS, EMPLOYEES OR AGENTS) BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE OR EXEMPLARY DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA OR LOSS OF GOODWILL, ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. WHERE APPLICABLE LAW LIMITS THIS EXCLUSION, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

You agree to indemnify and hold harmless Rica& and its affiliates, officers, directors, employees and agents from any claims, losses, liabilities, expenses (including reasonable attorneys’ fees) arising from your use of the site, your breach of these Terms, or your violation of any law or third-party rights.

13. TERMINATION

We may suspend or terminate access to the site or your account at any time for any reason, including violation of these Terms. Termination does not relieve you of obligations incurred prior to termination.

14. SEVERABILITY; WAIVER

If a court finds any provision of these Terms unenforceable, the remaining provisions will remain in full force. Our failure to enforce any right is not a waiver of that right.

15. GOVERNING LAW & DISPUTES

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Puerto Rico (without regard to conflict of laws principles). Any dispute arising out of or related to these Terms shall be brought exclusively in the state or federal courts located in Puerto Rico, and you and we consent to the personal jurisdiction of those courts.

(If you prefer a different governing law or a mandatory arbitration clause, please have your legal counsel advise. I included Puerto Rico because your business and operations are based there; change if needed.)

16. CHANGES TO THESE TERMS

We reserve the right to modify these Terms at any time. We will post the updated Terms with a new effective date. Your continued use of the site after any change constitutes acceptance of the revised Terms.
